How do appeals processes differ in the OSA vs DSA?
Questions & Answer
Both the DSA (EU) and OSA (UK) require appeals, but the emphasis differs:
DSA: Appeals must be available for all users, with structured escalation to out-of-court dispute resolution bodies.
Platforms must prioritise notices from trusted flaggers and act on them more quickly than general user reports.
Trusted flaggers are usually NGOs, regulators, or specialised entities with expertise in areas like child protection, counter-terrorism, or consumer fraud. Their role is to improve the accuracy and speed of moderation while reducing false positives.
Platforms must still review each notice but are expected to treat trusted flagger reports with high urgency. Abuse of the role can lead to withdrawal of the designation.
